Terms and Conditions
Order Policy and Agreement
The following policies are the (“Terms and Conditions”) set forth to preside over the sale of all products by Deep South Smokers (“DSS”) to its customers (“Customer”). These Terms and Conditions will govern all transactions between Deep South Smokers and the Customer.
ORDERS:
All orders are subject to acceptance by DSS. When a product is ordered, the Customer will receive an invoice for purchase. Orders are not fully processed until email acknowledgement is received by DSS. This acknowledgement is to ensure the Customer’s understanding of items purchased and for determination of order’s correctness. Orders accepted by DSS and described in the Terms and Conditions can only be cancelled by the Customer pursuant to the Cancellation Policy.
ONLINE ORDERS:
All online orders are subject to acceptance by DSS. When a product is ordered, the Customer will receive an email from Deep South Smokers within 24hours. Orders are not fully processed until email acknowledgement is sent by DSS. This acknowledgement is to ensure the Customer’s understanding of items purchased and for determination of order’s correctness. Orders accepted by DSS and described in the Terms and Conditions can only be cancelled by the Customer pursuant to the Cancellation Policy
CHANGES TO YOUR ORDER:
Any features added, modified, changed, etc. by the Customer after initial order must be verified/confirmed via email by the Customer to DSS. You may call our office to discuss the changes to your order however, we will still require written documentation of the changes and agreement to price.
CANCELLATION:
Deposits are non-refundable. Payments, whether deposit or in full, constitutes Customer’s agreement to DSS’s order policies stated above, regardless of a received Customer signed invoice. When you place an order, you are entering a legally binding contract to purchase that item, and your payment will be processed at the time the order is placed. If the Customer’s order is cancelled BEFORE it ships, you will forfeit your deposit. NO REFUNDS OR REBUILDS on any orders because of the custom nature of our products.
PAYMENT:
We accept the following forms of payment in USD currency: cash, personal check, business or cashier’s check, bank certified funds, money orders, and the following major credit cards (Visa, Master Card, Discover and American Express). All smoker builds require a minimum 50% deposit. Final payment plus any and all other charges must be made in full and allowed enough time to clear your bank prior to shipment or pickup.
RETURNS:
Returns are accepted only for defective products needing warranty repair. The Customer must first contact DSS to begin authorized return. Returns must be made within the 10 days of product acceptance. If a product is returned without contacting DSS, it will not be accepted. The customer is responsible for all shipping charges incurred in both directions for products that are returned to us for any reason other than cookers damaged in transit.
SHIPPING CHARGES:
Unless otherwise stated, crating and shipping fees will be charged for shipments to a customer’s residence anywhere in the contiguous United States, using a carrier of choice. Other terms apply to Alaska, Hawaii, Puerto Rico and export orders. Any extra charges incurred for additional services, such as customer’s carrier, or special handling by the carrier, must be paid by the consignee. Title and risk of loss pass to the customer upon tender of shipment to the carrier. If a product is damaged in transit, the consignee must file a claim with the carrier.
At DSS’s option, export orders may be subject to special export terms and conditions. All orders must include deposit or full purchase (at DSS’s discretion) thru Visa, MasterCard, Discover or American Express. All payments must be in U.S. dollars. Deep South Smokers shall have the right to set-off and deduction for any sums owed. If a customer fails to make payment within (5) days, Deep South Smokers may defer shipment until such payment is made, or may, at its option, cancel all or any part of unshipped order.
COMPLETION:
Our build-out dates are estimated from the date the paperwork is complete and deposit is received by DSS. We try to meet customer delivery requests as much as possible, but DSS does not guarantee completion or shipment on any particular date.
DISCLAIMER:
Payments whether deposits or payment in full constitutes customer’s agreement to Deep South Smokers’ order policies stated above, regardless of a received customer signed Invoice.
There are NO REFUNDS OR REBUILDS on any orders.
There are no guarantees given or implied on any estimated times of completion or delivery dates.
NOTE: Any and all specifications and policies are subject to change at Deep South Smokers sole discretion.
Limited warranty: All products sold are warrantied by Deep South Smokers against defects in workmanship or materials under normal use for one (1) year after date of purchase from Deep South Smokers unless otherwise stated. Any part which is determined by Deep South Smokers to be defective in material or workmanship and returned to Deep South Smokers shipping costs prepaid, will be repaired or replaced at Deep South Smokers’ discretion.
Warranty disclaimer: No warranty or affirmation of fact, express or implied, other than as set forth in the limited warranty statement above is made or authorized by Deep South Smokers. DSS disclaims any liability for product defect claims that are due to product misuse, improper product selection or misapplication, and any description that does not express or imply a warranty that the products are merchantable or fit for a particular purpose.
Limitation of liability: Any liability for consequential and incidental damages is expressly disclaimed. Deep South Smokers liability in all events is limited to, and shall not exceed the purchase price paid.
